1. Agreement to Terms

Welcome to Bümpis. These Terms of Service ("Terms") govern your access to and use of the Bümpis platform, including our website, mobile applications, NFC cards, and related services (collectively, the "Services").

By creating an account or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services.

2. Eligibility

You must be at least 16 years old to use our Services. By using Bümpis, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms. If you are using our Services on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

3. Account Registration

To access certain features of our Services, you must create an account. When you create an account, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized access to your account

4. Your Digital Business Card

Bümpis allows you to create and share digital business cards. You retain ownership of the content you add to your profile, but you grant us a license to use, display, and distribute that content as necessary to provide our Services.

You are solely responsible for the accuracy and legality of the information on your profile. You agree not to include any content that is false, misleading, defamatory, obscene, or otherwise objectionable.

5. Acceptable Use

You agree not to use our Services to:

• Violate any applicable laws or regulations
• Infringe on the intellectual property rights of others
• Transmit any malware, viruses, or harmful code
• Spam, harass, or abuse other users
• Impersonate any person or entity
• Interfere with or disrupt our Services
• Attempt to gain unauthorized access to our systems
• Scrape or collect data from our platform without permission
• Use our Services for any illegal or unauthorized purpose

6. Physical Products

If you purchase NFC cards or other physical products from Bümpis:

• All sales are final unless the product is defective
• We offer a 30-day warranty on manufacturing defects
• Shipping times are estimates and may vary
• You are responsible for providing accurate shipping information
• Risk of loss passes to you upon delivery to the carrier

7. Subscription and Payment

Some features of our Services require a paid subscription. By subscribing:

• You authorize us to charge your payment method on a recurring basis
• Subscriptions automatically renew unless cancelled before the renewal date
• Prices may change with 30 days' notice
• No refunds are provided for partial subscription periods
• You can cancel your subscription at any time through your account settings

For team plans, the account owner is responsible for all charges and managing team member access.

8. Intellectual Property

The Bümpis name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Bümpis. You may not use these marks without our prior written permission.

Our Services and their contents, features, and functionality are owned by Bümpis and are protected by copyright, trademark, and other intellectual property laws.

9. Third-Party Services

Our Services may integrate with or link to third-party services (such as social media platforms or CRM systems). We are not responsible for the content, privacy policies, or practices of any third-party services. Your use of such services is subject to their respective terms and policies.

10. Disclaimer of Warranties

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT OUR SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BÜMPIS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF OUR SERVICES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify and hold harmless Bümpis and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorney's fees) arising out of or related to your use of our Services, your violation of these Terms, or your violation of any rights of another.

13. Termination

We may suspend or terminate your account and access to our Services at any time, with or without cause, and with or without notice. Upon termination:

• Your right to use our Services will immediately cease
• Your profile will be deactivated
• We may delete your data in accordance with our Privacy Policy
• All provisions of these Terms that should survive termination will survive

14. Dispute Resolution

Any disputes arising out of or relating to these Terms or our Services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You agree to waive your right to a jury trial and to participate in a class action lawsuit. Notwithstanding the foregoing, either party may seek injunctive relief in any court of competent jurisdiction.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.

16. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by email or through our Services. Your continued use of our Services after the changes take effect constitutes your acceptance of the revised Terms.

17. Severability

If any provision of these Terms is held to be invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
